Autogate NW Terms April 1, 2023

I'm not a lawyer, and I'm used to a handshake closing the terms of a deal. This is my handshake, and you give me yours in exchange if you agree to abide by these terms below while conducting business with Delphi O.E.M. Co. If you don't agree, then do not request my services.

First a disclosure; I am doing business as Delphi O.E.M. Co., and AutoGate NW is a pending my registering it as a trade name with the state. ---I should have done this before becoming an electrical contractor as now fees and paperwork will need to be repeated, they tell me. I also do business as Polymer Wheels Company. ...So no checks yet to AutoGate NW, okay?

Also, I'm getting up there in age. So I don't move as fast as a young buck might. Expect a service call to take an hour or more. Expect to pay for a visit, even if just to discuss things, or if the gate cannot be fixed on that first visit. You may in advance set a limit on what you are willing to pay.

The cost to the client for service work is $120.00 per hour, billed by the quarter hour. The service fee will include drive time at the same rate. I use Google maps to find the drive times, from 216th Ave in Grand Mound to your site(s) ...and back. WA state adds on a tax on top, which you will also be billed for.

More often than not, a return trip is required. They will likewise include drive times. You have the option to approve more visits and set a monetary limit on what you are willing to spend. As a client, it is up to you to make any such limits known. You will be billed for services and parts up to that limit even if your gate system remains inoperable.

Occasionally a gate system has several things wrong with it: Repairing or replacing one thing only leading to another also preventing the gate from working. A chain of repairs can result, as the system is made up of a chain of devices ...such as replacing a battery in a flashlight may lead to replacing the light-bulb then finding that the switch is corroded.

When parts are required, you as the client may again place a limit on how much to spend. You will be notified of the cost of any part or component costing over $200, and given the chance to approve or decline.

The job is done when the repairs are completed or when your limits have been reached. Payment is due then after you receive the bill, with a grace period of ten days. Billing will be done by email and payment may be made online through PayPal.

Interest will be added to unpaid balances at the rate of 2% of the total unpaid balance each and applied to the total unpaid balance each month. Any balance after 3 months may be turned over to a collection agency.

Craftsmanship is guaranteed for a year. A bad weld, or loose wire etc. will be corrected within a year. Parts are excepted but may be covered by the manufacturer. We extend our guarantee to our labor to replace such parts which fail within a year.
